Domestic abuse victims need confidence in our justice system

A new court dedicated to tackling domestic abuse will be piloted at Livingston Sheriff Court tomorrow. It is hoped that the new court will lead to a rise in the number of perpetrators being convicted.

Scottish Conservative Justice Spokesman, David McLetchie MSP said:

"If another court dedicated to domestic abuse leads to a rise in the number of convictions then it is to be welcomed. However, our efforts will be seriously undermined if judges do not start handing out tougher sentences to those who are found guilty.

"What victims of domestic abuse need is confidence in our justice system and to know that if they come forward their attacker will be given a severe punishment.

"A zero tolerance approach to domestic abuse is being undermined by zero sentencing, with a third of those convicted being admonished and only 12% of cases resulting in a prison term. The majority of these were the short-term sentences of less than 6 months which the SNP are trying to abolish in favour of community sentencing.

"It is totally wrong that we have a criminal justice system that puts abusers straight back into the homes of their victims. While this new court may lead to higher conviction rates, it must also hand out tough sentences to those who commit these crimes."
